Apple has issued an official response to the ruling handed down by the Library of Congress on the matter of jailbreaking the iPhone. Today after much deliberation a final decision was announced by the governing body on issues of copyright infringement. The ruling goes as follows; an exception has been made to the DMCA that now allows you to legally jailbreak your iPhone in order to install unapproved applications and to unlock the device so the phone can be used with another service carrier.

CultofMac received a brief statement on the record from an Apple spokeswoman. Due to the legal nature of the issue she was unable to go into much detail:

“Apple’s goal has always been to insure that our customers have a great experience with their iPhone and we know that jailbreaking can severely degrade the experience. As we’ve said before, the vast majority of customers do not jailbreak their iPhones as this can violate the warranty and can cause the iPhone to become unstable and not work reliably.”

The Library of Congress has declared iPhone jailbreaking and unlocking as legal. New anti-circumvention exceptions has been introduced to the DMCA policies that now legally allow iPhone owners to jailbreak their devices and let them install 3rd party apps (not provided by iTunes Store).

According to the Associated Press, the decision to allow the practice commonly known as “jailbreaking” is one of a handful of new exemptions from a federal law that prohibits the circumvention of technical measures that control access to copyrighted works. Every three years, the Library of Congress authorizes such exemptions to ensure that existing law does not prevent non-infringing use of copyrighted material. Another exemption will allow owners of used cell phones to break access controls on their phones in order to switch wireless carriers.

This is, indeed,a great news for the jailbreak community! Spirit jailbreak for iPhone 4 and UltraSn0w unlock for iPhone 4 both will be out in a few days.

Step 1

Install the iTunes and .NET Framework 3.5 (required for Sn0wbreeze). Make sure you’ve installed the iTunes 9.2. Open the iTunes and backup your iPhone data. Now you can proceed. (Download Links below)

Put the iOS 4.1 beta Firmware and Sn0wBreeze v1.8 into a folder on your desktop. (Download links below)

Step 2

Run the Sn0wBreeze v1.8 for iOS 4.1 and hit next button.

Step 3

Choose Simple Mode. Click the Next Arrow button.

Step 4

Sn0wBreeze will ask for the iOS 4.1 beta IPSW file for your iPhone or iPod Touch. Click on the Browse button and navigate to the folder where you put your iOS 4.1 IPSW file and select it.

Step 5

Sn0wBreeze will verify your selected firmware 4.1 beta file. Then Hit Next.

Step 6

Hit the Start button. SnowBreeze will start building custom firmware for your iPhone that we will use later to jailbreak iOS 4.1.

Step 7

Once the custom firmware IPSW file building process is complete, Sn0wbreeze will prompt you to enter iDevice into recovery mode.

Step 8

Connect your iPhone to iTunes and select your iPhone from the left navigation pane in iTunes. Hold Down the SHIFT key on your keyboard and hit the Restore button (SHIFT + Restore)

Step 9

Now the iTunes will ask for the IPSW firmware file. Browse to the custom firmware iOS 4.1 that you built using Sn0wBreeze 1.8 and select it.

iTunes will Restore your iPhone with custom iOS 4.1 beta created with Sn0wBreeze. Once the iTunes is done with the restore process, your iPhone will restart automatically.

Voila! you’ve a fully jailbroken iPhone / iPod Touch with iOS 4.1 beta.

After months of silence, Geohot has finally published a new blog post in which he talks about iPhone 4 jailbreak situation, limera1n, and Pwned4life exploit which he recently talked about at the Nuit Du Hack conference in Paris. According to his latest blog post, he has managed to jailbreak his iPhone 4 the day it got delivered to him by mail. This is what he writes on his blog:

As far as a release goes, it probably won’t happen from me. limera1n is little more than a raindrop on a website; it was never mentioned by me previous to this post. pwned4life is a complete invention of some blogger in a basement somewhere. When I said pwned for life, I was referring to the original iPhone, 3G, and Touch; which of course are, by the aptly named PwnageTool.

Again, please don’t ask for release dates. Every person that does makes me want to release a little bit less.

iH8Sn0w has posted detailed instructions on how to jailbreak iPhone 3GS new bootrom running iOS 4 with Sn0wBreeze 1.6.2. Yes! using this method you can jailbreak iOS 4 on iPhone 3GS new bootrom. But there are few things to note first.

* This Jailbreaks iPhone 3GS New BootRom iOS 4 for now. [How to: check iPhone 3GS BootRom]
* You MUST have SHSH blobs saved for OS 3.1.2. The exploit used in this hack has been patched in OS 3.1.3 so firmware 3.1.2 is a MUST.
* It’s a tethered jailbreak. For those who don’t know, a tethered jailbreak device once turned off/Reboot/run out of battery, you need to connect it to computer and execute a tool to boot up the device.

III : Grab the kernelcache and bring it into the same folder as ibooty.
Also grab the iBEC from the folder “Firmware\dfu\iBEC.n88ap.RELEASE.dfu”

IV :
* Rename your iBSS 3.1.2 signed to “ibss312.dfu”
* Rename your Kernel 4.0-Custom to “kernel.40″
* Rename your iBEC 4.0-Custom to “ibec40.dfu”
